In terms section 2(1)(b) of the Matrimonial Causes Act [Chapter 5:13] as read with Rule 67(1) of the High Court Rules, 2021 a spouse who is without means to prosecute or defend an action for divorce or judicial separation, may apply for a contribution towards costs to the High Court of Zimbabwe.
The purpose of the contribution towards costs is to enable a spouse who would otherwise not be able to do so, to be in a position where they can be adequately place their matrimonial action before the court.In the application for contribution for costs, the spouse without the financial means to prosecute or defend the divorce action or judicial separation, must state the grounds of the action or defence. The applicant should also state that they have insufficient means with which to prosecute or defend the action, as the case may be, and furnish the court with whatever information that is available respecting the spouse’s financial position.
