What qualifies as a Civil Partnership in Zimbabwe?
Section 41 of the Marriages Act [Chapter 5:17] defines a ‘civil partnership’ as a relationship between a man and a woman who:
Are both above the age of 18;
Have lived together without legally being married to each other;
Are not related to each above by marriage (affinity);
Are not related by blood (consanguinity);
Having regard to the all the circumstances of their relationship, have a relationship as a couple living together of a genuine domestic basis.
In determining whether or not a civil partnership exists, the court will have regard to:
The duration of the relationship;
The nature and extent of the parties common residence;
Whether a sexual relationship exists;
The degree of financial dependence or interdependence, and any arrangements for financial support between the parties;
The ownership, use and acquisition of the parties property;
The degree of mutual commitment to a shared life;
The care and support of the children (if any); and
The reputation and public aspects of the relationship.
