Dispute resolution of disputes on the Zimbabwe Stock Exchange (ZSE) & Victoria Falls Stock Exchange (VFEX)
The Securities and Exchange Commission of Zimbabwe (‘SECZ’) established in terms of the Securities and Exchange Act [Chapter 24:25] in Zimbabwe has embraced the use of alternative dispute resolution (ADR) as the principal means of dispute resolution.
The main forms of ADR that parties generally used in the securities industry include:
- (a) Arbitration;
- (b) Conciliation; and
- (c) Mediation;
Arbitration appears to be the most common form of dispute resolution relied upon and used to resolve disputes in terms of the Victoria Falls Stock Exchange (VFEX) Central Securities Depositary (CSD) Rules, 2020; and the Zimbabwe Stock Exchange (ZSE) Central Securities Depository (CSD) Rules, 2021.
