DEBT COLLECTION
Zimbabwe, unlike South Africa does not have a piece of legislation i.e. the Debt Collectors Act 1998, which specifically regulates debt collection. A practice has developed in Zimbabwe where third parties, known as ‘debt collectors’ or ‘debt collection agencies’ are being engaged to collect debts in expectation of a fee, commission, gain or reward.
In terms of section 9(2) of the Legal Practitioners Act [Chapter 27:07], (the Act) apart from a director or an officer of a corporation, or a member of a partnership acting on behalf of that corporation or partnership, the practice of ‘debt collection in Zimbabwe’ is reserved for registered legal practitioners. Thus, in terms of the Act in Zimbabwe, a ‘debt collector’ or ‘debt collection agencies’ other than a legal practitioner cannot carry out debt collection services for gain or reward, as debt collection in Zimbabwe is specifically reserved for the legal profession.
