A de facto relationship is a relation between two adults who live together as a couple, without being legally married under civil or customary law in Zimbabwe. The term ‘de facto relationship’ is not commonly applied in Zimbabwe as in other Commonwealth jurisdictions. The more appropriate term is ‘civil partnership’.
Section 41 of the Marriages Act [Chapter 5:17] (‘the Act’) in Zimbabwe regulates de facto relationships and / or civil partnerships. One of the essential elements to prove a de facto relationship and / or civil partnership in Zimbabwe, is that the parties must show that they have lived together on a genuine domestic basis. However, it is yet to be determined by the courts in Zimbabwe how long the parties must have stayed and / or lived together as a couple on a genuine domestic basis, for the relationship to be deemed to be a civil partnership.
